By creating an account, accessing, or using Nettulz AI™ ("Service") operated by NETTULTECH CORPORATION ("Company"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, Cookie Policy, and AI Disclaimer.

If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and NETTULTECH CORPORATION.

You must be at least 13 years of age (16 in the EU/EEA) to use the Service. By using the Service, you represent that you meet this requirement. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NETTULTECH CORPORATION, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY OUTCOME, HARM, LOSS, OR DAMAGE (DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR PUNITIVE) ARISING FROM OR RELATED TO YOUR RELIANCE ON AI-GENERATED CONTENT OR YOUR USE OF THE SERVICE.

You are solely responsible for: (a) all decisions you make based on AI guidance; (b) maintaining the confidentiality of your account credentials; (c) all activities that occur under your account; (d) ensuring your use complies with all applicable laws and regulations in your jurisdiction.

You agree to provide accurate information during registration and to keep it updated.

You agree NOT to use the Service to:

• Engage in or promote illegal activities in any jurisdiction.
• Generate, distribute, or store content that is harmful, abusive, defamatory, obscene, or that violates the rights of others.
• Attempt to extract regulated professional advice (legal, medical, financial) and present it as such to third parties.
• Harass, threaten, or harm other users or our team.
• Reverse-engineer, scrape, or use the Service in ways that could harm its integrity or performance.
• Circumvent security measures or attempt unauthorized access.
• Use the Service on behalf of a competitor to build a competing product.
• Violate any applicable export control laws or sanctions regulations.

Violation of this policy may result in immediate account suspension or termination without refund.

The Service, its original content, features, and functionality are and will remain the exclusive property of NETTULTECH CORPORATION. Our trademarks, logos, and brand features may not be used without prior written consent.

AI-generated content produced in response to your prompts is provided to you for personal use. You may use it for personal, non-commercial purposes. We do not claim ownership of content you provide as input.

Paid plans (Premium, Professional) are billed on a monthly recurring basis. All payments are processed by Stripe and subject to Stripe's terms.

Free Trial: All paid plans include a 7-day free trial. Your card will not be charged until the trial ends. Cancel anytime before the trial ends at no cost.

Regional Pricing: Discounted prices are available for users in eligible regions (Africa and Asia) based on IP geolocation. Regional pricing is a courtesy and may be modified.

Cancellation: You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period; you retain access until then.

Price Changes: We will provide at least 30 days' notice of price changes via email.

We offer refunds within 7 days of initial payment if you are unsatisfied. After the trial period, refunds are assessed on a case-by-case basis. To request a refund, contact support@nettulzai.ai.

Chargebacks filed without first contacting us may result in account suspension. We comply with applicable consumer protection laws, including the EU Consumer Rights Directive and local equivalents.

Either party may terminate this agreement at any time. You may delete your account via account settings. We may suspend or terminate accounts that: violate these Terms; engage in fraudulent activity; or pose a risk to other users or the Service. We will provide reasonable notice where practicable.

Upon termination, your right to use the Service ceases immediately. Data deletion follows our Privacy Policy.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow limitation of liability for certain claims (e.g. consumer protection laws in the EU, Australia, and Canada). In such jurisdictions, our liability is limited to the fullest extent permitted by applicable law.

You agree to indemnify, defend, and hold harmless NETTULTECH CORPORATION and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

Governing Law: These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

Dispute Resolution: We encourage you to contact us first to resolve disputes informally. If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) rules, except where prohibited by local law.

EU/EEA/UK Users: Nothing in these Terms affects your rights under mandatory consumer protection laws in your country of residence. EU/UK residents may also use the EU Online Dispute Resolution platform at ec.europa.eu/odr.

Class Action Waiver: To the extent permitted by law, you agree to resolve disputes individually, not as a class member in a class or representative action.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notice at least 14 days in advance. Your continued use of the Service after changes take effect constitutes acceptance.

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and all other provisions remain in full force. These Terms, together with our Privacy Policy, Cookie Policy, and AI Disclaimer, constitute the entire agreement between you and NETTULTECH CORPORATION.
